These Terms and Conditions are the regulations referred to in Article 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended). They also regulate the conditions for concluding Sales Agreements in the Service, in accordance with the content of other acts that appropriately regulate this obligation.

The Service operates based on applicable laws and with respect for good practices in business transactions, particularly considering ecommerce standards regarding the quality of goods and the conduct of transactions.
Definitions:
The subject of the Service's activity is the sale of products. Matters not regulated by these Terms and Conditions will be governed by the relevant provisions of law in force in the territory of the Republic of Poland, in particular, the Act of April 23, 1964 – the Civil Code (Journal of Laws No. 16, item 93, as amended), the Act of May 30, 2014 on Consumer Rights (Journal of Laws 2014, item 827), and the Act of August 29, 1997 on the Protection of Personal Data (consolidated text: Journal of Laws of 2002, No. 101, item 926, as amended). The contents found on the Service, describing products, do not constitute a commercial offer within the meaning of the Civil Code. The price list found on the main page of the Service does not constitute a commercial offer within the meaning of the Civil Code.
The Client can place orders on the Service 24 hours a day, 7 days a week through the website www.zofiaszuca.com. The Service conducts sales within the territory of the Republic of Poland as well as outside the country. Information about products and services presented on the Service's website constitutes commercial information within the meaning of the Civil Code. Placing an order constitutes an offer within the meaning of the Civil Code, submitted by the Client to the Seller. To place an order, the Client should use the e-shop available at www.zofiaszuca.com. After placing a correct order, the order is considered placed. Orders placed in the aforementioned manner are confirmed via email. The moment the contract is concluded is therefore considered to be the sending of a confirmation email to the Client. The date of performance of the contract concluded through the Service is the day the ordered products are sent to the Client electronically.
All prices presented in the Service are gross prices, expressed in Polish zlotys, including VAT, specified by separate regulations. The Service provides the following types of payment:
The Customer places an order according to the prices valid at the time of placing the order. The Service reserves the right to change prices. This provision does not apply to orders already in process.
§4 Complaint Procedure
All complaints related to the provision of Services through the Service and questions regarding the use of the Service should be submitted to the email address: zofia.szuca@gmail.com. A properly submitted complaint should at least include the Client's details (name, surname, residential address, email address, contact phone number), and a description of the product being complained about. If the data or information provided in the complaint needs to be supplemented, the Service Provider will ask the complainant to provide additional information before considering the complaint. The time taken by the Service to provide additional explanations extends the complaint processing period. In the case of contracts concluded with Consumers, the Service is liable to the Consumer on the principles set out in Articles 556 and subsequent articles of the Civil Code for physical or legal defects (warranty). The Service will respond to the Consumer's submission within 14 (fourteen) days. Otherwise, it is considered that the Seller has acknowledged the Consumer's statement or demand as justified. If the Client, being a Consumer, has requested a service exchange or has made a statement on price reduction, specifying the amount by which the price is to be reduced, and the Service has not responded to this request within fourteen days, it is considered that the Service has acknowledged the request as justified. In the case of contracts concluded with Clients who are not Consumers at the same time, under Article 558 § 1 of the Civil Code, the Service's liability under the warranty is excluded.
The Consumer, based on Article 27 of the Consumer Rights Act, who has concluded a distance contract, may withdraw from it without giving any reason and without incurring costs, except for the costs specified in Articles 33, 34, and 35 of the Consumer Rights Act. In the case of digital products, the User agrees to the immediate delivery of the ordered digital content upon payment. The User thereby loses the right to withdraw from the contract upon receiving access, downloading the files to their computer, and starting to use the purchased digital product. The User can opt out of using the Service at any time. The Seller reserves the right to suspend, at any time and for any reason, the operation of the Service, as well as the right to modify or terminate the provision of Services through it.
§6 Technical Requirements and Information on Cookies
Recommended technical requirements for cooperation with the teleinformation system include a computer with Internet access, access to email, and an internet browser. The Service uses cookies technology. Cookies (also known as "cookies") are IT data, particularly text files, stored in the User's end device and intended for using the Service's website. The files mentioned in point 1 allow recognizing the User's device and appropriately displaying the website tailored to their individual preferences. §7 Final Provisions
The Service Provider reserves the right to make changes to the content available in the Service and to make possible changes to the product price list offered via the Service, depending on the changing average market rates. The Service Provider is not liable for:
Changes to the content of these Terms and Conditions may occur after informing Users about the scope of the anticipated changes no later than 14 days before their effective date. Orders placed during the validity of the previous version of the Terms and Conditions will be processed according to its provisions. Any disputes arising between the Seller and a Customer who is a Consumer will be resolved by the competent common court in accordance with the provisions of the Code of Civil Procedure. Any disputes arising between the Seller and a Customer who is not a Consumer will be resolved by the competent common court for the Service's registered office.

Using and distributing them without the Service owner's consent is prohibited. These Terms and Conditions are effective from 1.08.2024.
